Bond program benefits for developers and builders

The Land Development Bond Program affords Loxahatchee Groves Developers and Builders the opportunity to record subdivision plats and begin real estate transactions in the absence of completed required public improvements.  The Land Development Bond Program is designed to ensure the completion of required public improvements to Town of Loxahatchee Groves Standards.  Please note:  When a developer sells lots to another builder, the new owner needs to replace the bond.  The original bond will be returned upon receipt of the new bond.

Bond program benefits for homebuyers and citizens

The Program benefits Loxahatchee Groves homebuyers by ensuring the completion of required subdivision improvements in conformance with Town Ordinances and Standards - quality construction of streets, storm drains and sidewalks to ensure pedestrian safety, and the subsequent benefits of Street maintenance by the Town.  Bonds provide the Town with financial resources to complete required public improvements in the event of developer/builder default. 

Bond Release and Return

Bond release/returns may be requested by completing a Bond Refund Form. See link for document below.  Please note that the applicable bond refund fee must be submitted. The return will not be processed until the completed Bond Refund Request Form is submitted and payment is received.

The following requirements apply:

  • Bonds must be kept current and in effect until such time a final inspection is performed, and outstanding items are addressed (including the submission of required as-builts and copies of recorded plats). Upon approval, the Town Inspector will notify in writing to the Community Standards Director to release the bond.
  • Sidewalk bonds must be kept current and in effect until such time a final inspection is performed, outstanding items are addressed, and sidewalk improvements guaranteed by the bond are accepted by the appropriate Town Inspector. Upon approval, the Town Inspector will notify in writing to the Community Standards Director to release the bond.

Upon release, a transmittal letter is processed to the developer or builder. Checks to return cash sureties are issued by the Finance Department and are sent under separate cover from the transmittal letter, usually within thirty (30) business days.
